Terms of sale
- General provisions
1.1. These online store terms (the Terms) are a legally binding document between the Buyer and the Seller that sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, correct or supplement these Terms at any time. The Buyer is informed of changes to the Terms on the online store website.
- Conclusion of the sales contract
2.1. The sales contract between the Buyer and the Seller is deemed concluded when the Buyer, having read these Terms, creates and submits an order in the online store.
- Seller's rights
3.1. In the event of important circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability or security of the online store or breaches their obligations, the Seller has the right to restrict or suspend the Buyer's access to the online store without notice.
- Seller's obligations
4.1. The Seller undertakes to provide access to the online store services under the conditions set out in these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, under the conditions set out in these Terms.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the sales contract after informing the Buyer. The Seller may offer a similar product. If the Buyer declines, the Seller undertakes to refund the amount paid within 3 business days.
4.4. If the Buyer exercises the right provided in clause 5.2 of these Terms, the Seller undertakes to refund the amount paid within 5 (five) business days of receiving the returned goods.
4.5. The Seller may withhold the refund until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent back to the Seller, whichever comes first.
- Buyer's rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the sales contract concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right set out in clause 5.2 only if the goods have not been damaged, their appearance has not substantially changed and they have not been used.
- Buyer's obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with these Terms.
6.2. If the Buyer refuses to accept the goods at delivery without a valid reason, the Buyer must, at the Seller's request, cover the costs of returning the goods.
6.3. On delivery, the Buyer must check the condition of the parcel and the goods together with the Seller or the person delivering the parcel.
6.4. By using the online store, the Buyer confirms that they agree to these Terms and must comply with them.
- Prices
7.1. Prices in the online store are shown in euros and include VAT. Once the order is confirmed, a delivery charge is added to the total, where applicable.
- Ordering and payment
8.1. The Buyer chooses the goods they like in the online store and adds them to the shopping cart. After completing the cart, the Buyer enters the personal data needed to fulfil the order: name, surname, delivery address, telephone number and any additional information that may be relevant to delivery. The Buyer confirms that they have read these Terms and confirms the order.
8.3. Payment can be made via Swedbank, SEB and Luminor online banking, and by Visa/Mastercard payment cards. Payments are made in euros. Payments are processed via the MakeCommerce.lt payment platform.
- Delivery
9.1. When ordering, the Buyer must provide an accurate delivery address.
9.2. The Buyer must accept the goods in person. If the Buyer cannot accept the goods in person but the goods are delivered to the address provided by the Buyer, the Buyer has no right to make claims about the goods being handed over to the wrong person.
9.3. The Seller delivers the goods to the Buyer within the time frames stated in the product descriptions.
9.4. The features of all goods sold are set out in each product description. The Seller is not responsible if the colour, shape or other parameters of goods shown in the online store differ from the actual size, shape and colour due to the characteristics of the Buyer's monitor.
9.5. If the Buyer withdraws from the sales contract, all amounts paid by the Buyer are refunded, including the delivery costs paid by the Buyer.
- Returns
10.1. Goods of proper quality may be returned within 14 days of receipt. Defects in faulty goods are remedied, and faulty goods are exchanged or returned in accordance with the Civil Code of the Republic of Lithuania.
10.2. The following conditions apply to returns:
10.2.1. The returned item must be in its original, undamaged packaging (does not apply to faulty goods);
10.2.2. The item must not have been damaged by the Buyer;
10.2.3. The item must be unused and in resaleable condition: labels intact, protective films not removed, etc. (does not apply to faulty goods);
10.2.4. The returned item must be complete, as received by the Buyer (does not apply to faulty goods);
10.2.5. The Seller has the right to refuse returned goods if the return conditions have not been met;
10.2.6. Goods are returned in the manner specified by the Seller within 14 (fourteen) days of receipt (does not apply to faulty goods, which are returned within the statutory warranty period);
10.3. Returns and exchanges of goods of proper quality are carried out in accordance with Article 6.228(10)(1) of the Civil Code;
10.4. For goods accepted by the Buyer and later returned, the money paid is refunded to the Buyer's account no later than 5 (five) days from the date the goods are returned to the Seller, unless the Seller and the Buyer agree otherwise.
- Final provisions
11.1. These Terms are drawn up in accordance with the laws of the Republic of Lithuania.
11.2. These Terms and the relations between the Parties regarding these Terms are governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising from the performance of these Terms are resolved through negotiation. If no agreement can be reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
11.4. The Parties are released from their obligations under these Terms if they cannot be performed due to unforeseen circumstances beyond the Parties' control (force majeure).
